openRX deactivated, but when I turn them on it seems my radio is unlocked!

Description
So I'm new to HAM radio in general, and got a M-5R as a way to test the waters before I get my licence. I was confused by the Amazon listing as it said to use both 5RX and UV-5X options. I tried 5RX first but it failed to communicate, so I tried the UV-5X option next and that worked, great! I program my channels, and see there is an option to deactivate tranmit for VHF and UHF; since I don't have a licence yet, great!
After learning more abour the radio I realise I should be using 5RX instead since it has the 3 band options, etc. but I also realise it can't turn the VHF and UHF RX on or off... huh. So now I can't transmit. So I go back to the UV-5X, turn the RX back on, upload it to the radio, then I immediately download from radio the 5RX. ok RX works again! but come to realise now I can transmit on any frequency, even emergeny ones in the 155mhz range!! This is not good and have since does this process again to turn it all back off. It seems I've somehow unlocked the radio when I did not want to.
- Is there the option to turn VHF/UHF RX on/off from the 5RX profile?
- how can I control the range of RX frequencies, while keeping the TX frequency range open for on-radio typing? (seems I can control the range to be legal, but then I can't scan or otherwise type in a freq outside the range)
- I notice the frequency ranges are yellowed when I download from radio. Is this an issue or an artifact of the multiband nature of this radio?

Unfortunately many Baofeng radio models will respond to more than one model when downloading or uploading. This means, for example, that the CHIRP will read a read a radio that had 2 TX power levels (UV-5R) when the user has selected a model that has support for a radio with 3 TX power levels (BF-F8HP). This won't give the UV-5R support for 3 TX power levels, it will just fail setting some power levels because the physical radio does not match the radio model that was selected in CHIRP.
Because of this the user is responsible for choosing the CHIRP model selection that matches the capability of the physical radio being programmed. According to the CHIRP Support Radio Models list, the correct selection for the M-5R is the 5RX.

The settings Other Settings tab that intended to allow transmit to be disabled independently for the VHF and UHF bands has been available since the driver was originally developed back in 2012. Unfortunately is has been very rare for any of these radio to actually support this setting. In other words, ticked or not, the TX capability will not be disabled in these radio.
The correct way to disable transmit for most radios models that support it (these radios should) is to set the Duplex field to off for every memory row that you would like TX disabled.

What's odd then is that I can indeed turn the TX off by checking the VHF/UHF check boxes. but I have to load up the wrong profile in order to do so and then go back to the correct 5RX profile. Doing a factory reset also did not resolve the problem. Is there something I can upload that would indeed truly factory reset the radio?

oh wait, are you saying that even if the TX light on the radio does not light up the radio power is still transmitting without me knowing if I hit the PTT?
